Searches for “crypto TDS India” often treat the 1% deduction as if it were the final tax on a trade. Section 194S is a tax deduction at source connected to consideration for a transfer of a virtual digital asset (VDA); the Income Tax Department’s current explainer states a 1% rate and includes provisions amended by the Finance Act, 2026. A deduction recorded by an exchange is therefore a separate item to reconcile, not a direct measure of profit or a complete calculation of income tax due.

Start with the transaction, not the wallet balance

The official explanation frames the obligation around a payment to a resident as consideration for transferring a VDA. The person responsible for paying can differ by transaction structure. For an over-the-counter transaction between a known buyer and seller, the buyer is the deductor. For an exchange trade, the exchange may deduct when it pays the seller directly. If a broker passes the payment, responsibilities can depend on the arrangement between the exchange and broker. A crypto-to-crypto exchange also involves a transfer on both sides, and the department describes circumstances where a platform may deduct under a written agreement with its users.

These distinctions make it risky to assume every screen label or every token movement is treated the same way. A wallet transfer between addresses you control is not automatically a sale merely because it appears as a withdrawal, but the actual facts and documentation matter. Conversely, a swap or trade can involve a transfer even if no rupees reach your bank account. Keep the order record, payment record, exchange statement and transaction hash so you can explain what changed hands and who paid consideration.

Check the threshold and timing in the current rule

The department’s page says no deduction is required if aggregate consideration payable during the financial year does not exceed ₹10,000, or ₹50,000 when the payer is a specified person. It also says deduction is due at payment or credit, whichever occurs first; for intraday crypto trading it may apply each time a transaction is squared off. The page describes specified persons and notes that the Finance Act amendments affect the current wording. Do not rely on an old blog post for a threshold or deductor rule. Check the current Income Tax Department page and the relevant law or notification for your transaction date.

Where the consideration is in kind, the tax department says the required deduction must be paid before releasing the consideration if there is not enough cash to meet it. The Department also explains that the amount is calculated on net consideration after excluding GST or service charges levied by the deductor. Those details can make two trades with similar gross values produce different figures in a platform statement. Read the transaction confirmation to see the amount, currency, fee line and deduction separately.

Reconcile exchange deductions with your records

Download trade history and any TDS or tax statement from each platform, then group transactions by date, token, quantity, consideration and counterparty route. Compare the deduction shown by the exchange with amounts credited in official tax records when those become available. If the platform records a deduction but the statement lacks a corresponding trade, check for failed or reversed orders, partial fills, a separate broker leg or a reporting delay. Do not silently overwrite the exchange history to make totals match.

Keep a column for the gross consideration, any platform service charge, the TDS amount, and the final cash or token amount received. For a swap, preserve the details for both sides and the agreement or confirmation showing who handled withholding. Save the source file unchanged and keep a working copy for calculations. If two exchanges report the same transfer, identify which one was the deductor and whether the entries refer to different legs rather than counting the deduction twice.

TDS is not a trading fee or profit tax calculation

A TDS line may reduce the cash credited from a sale, while a trading fee reduces the proceeds separately. A deduction can be higher than a trader’s net profit because it is based on consideration under the stated rule, not simply the gain on the position. That does not by itself establish the final tax liability or whether any credit, adjustment or refund is available in an individual filing. Keep the certificate and supporting transaction records, and use the applicable return guidance for your own situation.

  • Identify the exact VDA transfer and consideration in the transaction.
  • Check who was responsible for withholding in that route.
  • Confirm the financial-year threshold and rule version for the date.
  • Separate TDS, exchange fees, GST and the final amount received.
  • Retain the platform statement and verify the official tax record.

Build a transaction level TDS file

Keep the consideration, transfer date, asset, counterparty route, exchange statement and TDS certificate together for each relevant transfer. Record whether the platform deducted tax at execution, later adjusted a shortfall, or reported a value that differs from your own ledger. Crypto to crypto trades and transfers through a broker can create multiple records, so preserve the order IDs and both sides of the transaction rather than copying a single annual total. If an exchange export uses UTC while a tax document uses another date convention, note the conversion instead of silently changing the original time.

Reconcile the tax deducted with the available tax statement and the information shown in your account before filing. A deduction under Section 194S is separate from a trading fee and does not by itself establish the final tax on a gain. Keep purchase evidence, sale consideration, transfer fees and any correction messages in a folder for the financial year. When one party reports an amount that you cannot match to a transaction, ask the platform through its official support channel and save the reply. Check the current Income Tax Department instructions for the relevant year; do not rely on an old form or on a calculation made for another asset or transaction route.
